These Terms of Service ("Terms") govern your access to and use of the Roster platform, including the website at roster.ie, mobile applications, and all related services (collectively, the "Platform"), operated by Roster Technologies Limited, a private company limited by shares registered in Ireland under company number 813185, with its registered office in Dublin ("Roster", "we", "us", or "our").
By creating an account, accessing, or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and any additional terms that apply to specific features. If you do not agree to these Terms, you must not use the Platform.
To use the Platform, you must create an account by providing accurate, current, and complete information. You must be at least 18 years of age and legally permitted to work in Ireland.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.
We reserve the right to verify your identity, request additional documentation (including proof of right to work, identification documents, or professional certifications), and to suspend or terminate accounts that provide false or misleading information.
Workers may browse and apply for available shifts through the Platform. Submitting an application does not guarantee acceptance. Venues retain sole discretion over which applicants to accept, aided by the Platform's quality scoring system.
Once accepted for a shift, you are expected to attend punctually and complete the full duration of the shift. Failure to attend a confirmed shift without adequate notice constitutes a "no-show" and will negatively impact your Reliability Score.
Workers may cancel a confirmed shift through the Platform. However, late cancellations (less than 24 hours before the shift start time) will result in a reduction to your Reliability Score. Repeated late cancellations or no-shows may result in temporary or permanent suspension from the Platform.
Workers are required to check in to shifts using the GPS-based check-in feature on the mobile application. Check-in data is used to verify attendance and calculate hours worked. By using this feature, you consent to the collection of your location data during the check-in process.
Workers are paid for completed shifts based on the hourly rate displayed at the time of application. Payment is processed through our payment partner, Stripe, via Stripe Connect. You must complete Stripe Connect onboarding to receive payments.
Payments are typically processed within 3-5 business days after the Venue confirms hours worked. Instant payout may be available for eligible Workers, subject to Stripe's terms and any applicable fees.
The nature of the working relationship between a Worker and a Venue is determined by the parties themselves and the specific circumstances of each engagement. Roster is a technology platform that facilitates connections between Workers and Venues. Roster does not act as an employer, employment agency, or employment intermediary, and is not a party to any employment or contractual relationship between Workers and Venues. For permanent positions (Jobs), the employment relationship is directly between the Worker and the Venue. Workers and Venues are solely responsible for determining and complying with any applicable employment, tax, and social insurance obligations.
Venues may post shifts by providing accurate details including role, date, time, location, and hourly rate. The minimum hourly rate for any shift posted on the Platform must comply with the Irish national minimum wage and any applicable sectoral employment orders.
Venues may review applications and accept or decline applicants. The Platform provides quality scoring to assist in decision-making, but the Venue retains full responsibility for hiring decisions and must comply with all applicable employment and anti-discrimination legislation.
When a Venue posts a shift, the estimated cost may be pre-authorised or held on the Venue's payment method. Final charges are calculated based on the actual hours confirmed by the Venue after the shift is completed.
Venues that cancel a shift after a Worker has been confirmed may be subject to cancellation fees, particularly if the cancellation occurs within 24 hours of the shift start time. The specific fee structure is communicated at the time of posting.
Venues are responsible for providing a safe working environment, complying with all applicable health and safety legislation, and ensuring that Workers are properly briefed on their duties and any relevant safety procedures.
Roster operates a marketplace model. The Platform retains a platform fee that is already included in the total rate set by the Venue — it is not an additional charge added at checkout. The rate displayed to a Worker is the amount that Worker will receive, and the rate set by a Venue is the amount that Venue will pay. There are no separate or hidden charges added to either party at the point of payment.
All payment processing is handled by Stripe. By using the Platform, you agree to Stripe's terms of service and connected account agreement. Roster is not responsible for any delays, errors, or failures caused by Stripe or other third-party payment processors.
You agree that when using the Platform, you will not:
We reserve the right to remove content and suspend or terminate accounts that violate these conduct rules, at our sole discretion and without prior notice.
All content on the Platform, including but not limited to text, graphics, logos, icons, images, software, and the compilation thereof, is the property of Roster Technologies Limited or its licensors and is protected by Irish and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Platform without our prior written consent.
By submitting content to the Platform (including profile information, reviews, and messages), you grant Roster a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display such content in connection with operating the Platform.
To the maximum extent permitted by Irish law, Roster Technologies Limited, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform.
The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Roster does not guarantee the accuracy, completeness, or reliability of any information on the Platform, including but not limited to user profiles, ratings, reviews, and shift details.
If a dispute arises between a Worker and a Venue regarding a shift (including but not limited to hours worked, payment, or conduct), either party may submit a dispute through the Platform. Roster will review disputes in good faith and may mediate, but is not obligated to resolve disputes between users.
Any dispute arising out of or relating to these Terms or the Platform that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Ireland.
We process personal data in accordance with the General Data Protection Regulation (EU) 2016/679 ("GDPR") and the Irish Data Protection Acts 1988-2018. Full details of how we collect, use, and protect your personal data are set out in our Privacy Policy.
By using the Platform, you acknowledge that you have read and understood our Privacy Policy and consent to the processing of your personal data as described therein.
You may terminate your account at any time by contacting us or using the account deletion feature in the Platform settings. Upon termination, your right to use the Platform ceases immediately.
We may suspend or terminate your account at any time, with or without cause and with or without notice, including but not limited to breach of these Terms, abusive behaviour, fraud, or prolonged inactivity.
Provisions of these Terms that by their nature should survive termination (including but not limited to intellectual property, limitation of liability, and dispute resolution) shall survive.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on the Platform at least 14 days before the changes take effect.
Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform and close your account.
These Terms shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.
